These Terms and Conditions set out the basis on which Waste Clearance Ilford provides waste clearance and related services to residential and commercial customers. In these Terms and Conditions, the following definitions apply:
1.1 "Company" means Waste Clearance Ilford, the provider of waste collection and clearance services.
1.2 "Customer" means any individual, business, landlord, managing agent, or other party who requests or receives services from the Company.
1.3 "Services" means the collection, clearance, loading, transportation, and lawful disposal of waste or items as agreed between the Company and the Customer.
1.4 "Waste" means any items, materials, refuse, rubbish, junk, furniture, appliances, or other goods that the Customer asks the Company to remove, subject to applicable legislation and any exclusions stated in these Terms and Conditions.
1.5 "Booking" means an order or request placed by the Customer for the Company to carry out Services at an agreed time, date, and location.
2.1 The Company provides waste clearance and collection services for domestic and commercial premises, including but not limited to houses, flats, offices, shops, and light industrial units.
2.2 The Company will collect and dispose of waste in accordance with applicable UK waste management legislation and local regulations. All waste will be taken to authorised facilities or transfer stations where reasonably practicable.
2.3 The Company reserves the right to refuse the collection or handling of any waste that it considers hazardous, illegal, unsafe, or unsuitable for removal, including but not limited to asbestos, certain chemicals, gas bottles, clinical or medical waste, or any materials requiring specialist handling or licences beyond those held by the Company.
2.4 The Company may, at its discretion, provide additional services such as light dismantling, basic removal of fixtures, and minor lifting, provided it is safe and agreed at the time of the Booking or on arrival at the premises.
3.1 Customers can request Services by telephone, email, or online enquiry. The Customer must provide accurate information about the type and approximate volume or weight of waste, access conditions, and any relevant restrictions such as parking or building rules.
3.2 Any quotation provided prior to attending the premises is based on the information supplied by the Customer. The final price may be adjusted if the actual volume, weight, type of waste, or access conditions differ from those described during the Booking process.
3.3 A Booking is only deemed confirmed when the Company has accepted the request and provided confirmation by telephone, email, or other written communication, or when a mutually agreed arrival time has been arranged.
3.4 The Customer must ensure that a responsible person is present at the premises at the agreed time of arrival to grant access, confirm the items to be removed, and approve any changes to the quotation where necessary.
3.5 The Company will use reasonable efforts to arrive within the agreed time window. However, all times are estimates and may be affected by traffic conditions, previous jobs, or unforeseen circumstances. The Company will endeavour to notify the Customer of any significant delays.
4.1 Quotations are usually based on the estimated volume of waste to be removed, the type of waste, access conditions, labour involved, and any disposal charges. Prices may be expressed as a fixed fee, a range, or a guide price per load size.
4.2 Upon arrival, the Company will inspect the waste and confirm the final price before starting work. If the Customer does not agree with the revised price, the Company will not be obliged to proceed and no charge will be made, except for any agreed call-out or attendance fee clearly communicated in advance.
4.3 All prices are provided in pounds sterling and may be stated inclusive or exclusive of VAT, as clearly indicated in the quotation or invoice. Where applicable, VAT will be charged at the prevailing rate.
4.4 Additional charges may apply for difficult access, excessive loading times due to circumstances beyond the Company’s control, specialist waste, parking fees or fines incurred in the course of carrying out the Services, or any additional labour requested on site.
5.1 Payment is due on completion of the Services unless otherwise agreed in writing prior to the Booking. The Company may require a deposit or full payment in advance for certain jobs or for new commercial Customers.
5.2 The Company accepts payment by cash, bank transfer, or major credit and debit cards, subject to any processing fees which will be disclosed to the Customer.
5.3 For approved commercial Customers with credit terms, invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.
5.4 If the Customer fails to make payment on the due date, the Company reserves the right to charge interest on the overdue amount at the statutory rate permitted under UK law, and to suspend or withdraw any further Services until all outstanding sums are paid in full.
5.5 The Customer shall be responsible for all reasonable costs and expenses incurred by the Company in recovering any overdue payments, including legal fees and debt collection costs.
6.1 The Customer may cancel or amend a Booking by giving the Company at least 24 hours’ notice before the agreed arrival time. Cancellations or amendments within 24 hours may incur a cancellation fee to cover costs incurred by the Company.
6.2 The Company reserves the right to cancel or postpone a Booking where it is unable to attend due to circumstances beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, accidents, or staff illness. In such cases, any deposits paid will be refunded or the Booking rescheduled by mutual agreement.
6.3 The Customer must ensure that the Company has adequate access to the premises and waste. This includes arranging any necessary permissions, parking provisions, security clearances, or lift access. If the Company is unable to access the site or waste due to reasons beyond its control, it may charge a wasted journey fee or a proportion of the agreed price.
6.4 If the Customer is not present at the agreed time and has not made prior arrangements for access, the Company may, at its discretion, wait for a reasonable period, charge waiting time, or treat the Booking as cancelled by the Customer.
7.1 The Customer is responsible for accurately describing the waste to be removed and for separating or identifying any items that should not be taken. The Company accepts no liability for items removed in good faith where they were presented as waste or not clearly separated.
7.2 The Customer must ensure that the waste is reasonably accessible and not contaminated with hazardous or prohibited materials. If such materials are discovered, the Company may refuse to remove them or apply additional charges for safe handling and disposal where legally permissible.
7.3 The Customer must take all reasonable steps to ensure a safe working environment for the Company’s operatives, including keeping children and pets away from the work area and informing the Company of any known risks, such as structural weaknesses, broken glass, or sharps.
7.4 The Customer remains responsible for the premises and is required to check the area before and after the clearance. Complaints regarding missing items must be raised immediately on site or within a reasonable time after completion of the Services.
8.1 The Company operates in accordance with UK waste management legislation and relevant environmental regulations. Where required, the Company holds appropriate licences or registrations to transport and dispose of controlled waste.
8.2 The Customer acknowledges their ongoing duty of care under UK law to ensure that waste is transferred only to authorised carriers and that it is managed lawfully. By engaging the Company, the Customer confirms that they are discharging this duty by using a compliant service provider.
8.3 The Company will, where appropriate, provide waste transfer notes or other documentation required by law to evidence the lawful transfer and disposal of waste. The Customer should retain such records for their own compliance purposes.
8.4 The Company aims to reduce the amount of waste sent to landfill by prioritising reuse and recycling where facilities are available. However, the Company does not guarantee that any particular item will be reused or recycled and will select disposal routes at its discretion, in line with legal requirements.
9.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company’s liability to the Customer is limited as set out in this section.
9.2 The Company shall not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, loss of data, or loss of opportunity, arising out of or in connection with the provision of the Services.
9.3 The Company’s total liability for any claim arising under or in connection with the Services, whether in contract, tort, negligence, or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Booking that gave rise to the claim.
9.4 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by the Company’s negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded under UK law.
9.5 The Customer shall be responsible for securing or removing any items they do not wish to be taken. The Company is not liable for loss or damage to items that the Customer has left in areas designated for clearance, or which could reasonably be mistaken as waste.
9.6 The Company will not be liable for minor cosmetic damage to floors, walls, or fixtures where such damage is reasonably incidental to the normal performance of the Services, particularly in circumstances involving large or heavy items and restricted access.
10.1 The Company maintains public liability insurance and, where applicable, employer’s liability insurance to cover its operations in connection with waste clearance and collection activities.
10.2 Details of the Company’s insurance cover can be provided to the Customer upon reasonable request.
11.1 If the Customer is dissatisfied with any aspect of the Services, they should raise the issue with the Company as soon as possible, and in any event within 48 hours of completion of the Services.
11.2 The Company will investigate all complaints in good faith and attempt to resolve the matter promptly, which may include revisiting the premises, offering a partial refund, or taking corrective action where appropriate.
11.3 If a dispute cannot be resolved amicably, the parties may consider mediation or other alternative dispute resolution methods prior to commencing formal legal proceedings.
12.1 The Company collects and processes personal data such as names, contact details, addresses, and job information for the purpose of managing Bookings, providing Services, and fulfilling legal obligations.
12.2 The Company will handle personal data in accordance with applicable UK data protection laws and will not sell or share Customer data with third parties except where required to deliver the Services, comply with legal obligations, or with the Customer’s consent.
13.1 The Company reserves the right to amend these Terms and Conditions from time to time. Any updated version will apply to new Bookings made after the date of publication of the revised terms.
13.2 For ongoing commercial arrangements, the Company will notify Customers of any material changes to these Terms and Conditions, and continued use of the Services after such notification will constitute acceptance of the updated terms.
14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable.
15.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy.
15.3 These Terms and Conditions, together with any written quotation or confirmation issued by the Company, constitute the entire agreement between the Company and the Customer in relation to the Services and supersede all prior discussions, correspondence, or understandings.
By making a Booking or allowing the Company to commence work, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
